NEMA Warns Kilimani Developer Over Dust, Construction Debris Affecting Residents

Kenya, August 5, 2026 - The National Environment Management Authority (NEMA) has issued a stern warning to a developer behind a residential project along Lenana Road, Kilimani, over pollution that has affected neighbouring residents.

This is after NEMA officers conducted a site inspection on Tuesday at the project, which is being overseen by Rodol Homes Limited, following complaints from residents.

The officers have established that dust and debris from the construction site had adversely affected nearby homes,  a situation that has forced some residents to temporarily relocate due to the construction activities.

The officers have directed the developer to implement adequate dust-suppression and debris-management measures to ensure compliance with environmental regulations.

The inspection comes amid increased scrutiny of construction activities in Nairobi and other urban areas, where Kenyans have raised concerns over poor waste management and failure to control dust emissions at the sites.

In a separate incident along Muthithi Road, NEMA inspectors intervened after a sewerage spill caused by interference with a sewer line by Novolumen Nairobi Ltd, resulting in a blockage and overflow into other apartments.

“Elsewhere, there was a sewerage spillage along Muthithi Road. Novolumen Nairobi Ltd had interfered with the sewer line while attempting to clear it with a metal rod. This resulted in a blockage and an overflow of sewer onto Kathera Apartment grounds,” the authority stated.

The company was ordered to clear the spillage and was cautioned against tampering with the sewer system and notifying Nairobi City Water and Sewerage Company anytime there was a blockage.

Failing to follow environmental rules during apartment construction in Nairobi or other Kenyan cities breaches Article 69 of the Constitution.

This triggers public interest lawsuits under Article 70, immediate site demolitions, heavy statutory fines up to Ksh 2 million, and criminal prosecution.
