Kenya, April 27, 2026 - Former Deputy President Rigathi Gachagua walked into the Milimani High Court on Monday flanked not just by lawyers, but by family and a visible show of political support, as the legal battle over his impeachment formally got underway.
Accompanied by his wife, Pastor Dorcas Rigathi, and their two sons, Gachagua was joined by opposition figures led by Wiper leader Kalonzo Musyoka and DAP-K leader Eugene Wamalwa. A number of allied lawmakers also attended, turning the court session into a moment watched closely beyond the courtroom.
The case, now before a three-judge bench comprising Justices Erick Ogolla, Anthony Mrima and Freda Mugambi, centres on Gachagua’s challenge to his October 2024 impeachment—an event that made history as the first of its kind for a Deputy President in Kenya.
Through his legal team, led by Senior Counsel Paul Muite, Gachagua argues that the process was flawed, citing procedural irregularities and violations of his constitutional right to a fair hearing.
Ahead of the session, he struck a calm tone, expressing confidence in the judiciary. “Day 1 at the Milimani High Court… May justice prevail,” he posted.

For his allies, however, the moment carried broader meaning. Kalonzo described the proceedings as more than a personal case, framing them as a test of constitutional order and the rule of law.
“What unfolds today is not merely a legal proceeding; it is a defining moment for our democracy,” he said.
Inside court, judges are expected to consider multiple applications, including requests for interim orders and arguments touching on the limits of parliamentary power and the legal threshold for impeachment.
