Kenya, June 29, 2026 - The Office of the Director of Public Prosecutions (ODPP) has secured the conviction and a cumulative 70-year prison sentence against two men found guilty of robbery with violence, gang rape and sexual assault.
In a judgment delivered at the Kibera Law Courts on June 29, 2026, Senior Principal Magistrate Irene Kahuya convicted Cleff Juma Mbaka and Mursal Kafe, also known as Muu Nasur, after the prosecution proved the charges beyond reasonable doubt.
The prosecution, led by Principal Prosecution Counsel Hilda Omondi, presented evidence from six witnesses showing that the complainant had been lured to Nairobi under the pretext of a business opportunity. Once in the city, the victim was robbed of a mobile phone, cash and personal documents before being drugged and subjected to sexual offences. The complainant was later abandoned at Lang'ata Cemetery with serious injuries that required emergency surgery.
According to the ODPP, the court relied on the complainant's consistent testimony, corroborating medical evidence, a motorcycle tracking report, documentary evidence linking the motorcycle to one of the accused, and other circumstantial evidence that placed both men at the scene of the crime. The defence argument of mistaken identity was dismissed.

The court sentenced the two convicts to 30 years' imprisonment for robbery with violence, 20 years for gang rape and a further 20 years for sexual assault. The sentences will run consecutively, resulting in an effective custodial sentence of 70 years after accounting for the eight months they had already spent in custody.
While delivering the sentence, Magistrate Kahuya said the punishment reflected the seriousness of the offences and would serve as a deterrent against violent and sexual crimes. The court also cautioned boda boda operators against allowing their motorcycles to be used in criminal activities.
