Somalia, 20 April 2026 Somalia’s constitutional commission directed officials holding both cabinet and parliamentary roles to choose one role under the amended constitution.
In a press statement, the commission said it is unconstitutional for a single individual to simultaneously hold both a ministerial and parliamentary role, stressing that any action that contradicts the constitution will be considered unlawful.
“Any action, appointment, or conduct carried out by state institutions must comply with the provisions of the Constitution of the Federal Republic of Somalia. Anything that contravenes the constitution is null and void,” the statement said.

The commission specifically noted that members of the Council of Ministers and both houses of the Federal Parliament are required to select one role, in accordance with Articles 8, 44, and other relevant constitutional provisions.
It added that the commission will continue monitoring and ensuring the implementation of the constitution, while also proposing amendments and improvements where necessary.
The statement comes amid growing debate over the separation of powers and adherence to the rule of law, with the commission urging all state institutions to fully respect the constitution.
