Somalia, 12 June 2026 – Somali President Hassan Sheikh Mohamud has ruled out a return to Somalia’s 2012 provisional constitution, saying the country has already moved beyond that stage of the constitutional process.
Speaking on Miisaan Podcast, the president described the 2012 constitution as part of Somalia’s constitutional history rather than a document to which the country could simply revert. “It took its place in the archives,” he said.
He stressed that the current constitutional review process did not create an entirely new constitution but instead amended sections of the existing provisional charter.
According to Hassan Sheikh, constitutional documents are living instruments that can be revised through established legal procedures.
He said individuals or groups seeking changes should identify specific articles and propose alternative wording supported by clear legal and political arguments.

The president argued that constitutional disputes should be resolved through the mechanisms already outlined within the constitution itself.
He also defended the decision to continue the constitutional review process, saying successive governments had postponed the task despite provisions requiring a review.
Hassan Sheikh said Somalia should focus on improving and completing the constitutional framework rather than attempting to return to earlier versions of the document.
