Kenya, 21 October 2026 - Psychiatrist Prof David Ndetei was on Wednesday wheeled into the Milimani High Court to be cross-examined on an affidavit opposing the release of his ex-wife, Rose Mbithe Mulwa, and her two children, Chris and Angela, who are charged with the murder of Dr Victoria Nthunya Mutiso.
This is after Ms Mulwa alleged that the affidavit is a forgery and that it was signed by someone else and not her ex-husband.
The two will meet in court for the first time in about 30 years since their separation, with Ms Mulwa, through her lawyers, set to question her former husband on the document.
Ms Mulwa, Chris and Angela are charged alongside four others with the murder of Dr Mutiso, Prof Ndetei’s wife. In the affidavit filed on 5 October 2026, Prof Ndetei claims Ms Mulwa has repeatedly threatened him, and that releasing the three on bond would endanger his life and those of other witnesses.
Ms Mulwa’s lead counsel, Joel Mbaluka, told Justice Alexander Muteti that the affidavit was a forgery.

At the time, he argued that Prof Ndetei was undergoing treatment with serious health challenges and lacked the capacity to swear an affidavit.
It is against that backdrop that Mr Mbaluka, who is leading three other lawyers, asked the court to summon Prof Ndetei for cross-examination so that justice would be seen to be done in the bail application.
Allowing the application on 19 October 2026, Justice Muteti said doubts had been raised about the authenticity of the affidavit.
“In order to clear the air as to the correctness of the affidavit complained about by Ms Mulwa, Chris and Angela, this court hereby directs the deponent to appear in court for cross-examination on the issues he has raised,” the judge ruled.
