Kenya, September 04, 2026 - The decision by the Public Procurement Administrative Review Board (PPARB) to order the Independent Electoral and Boundaries Commission (IEBC) to amend its 2027 election technology tender has largely been presented as a procurement dispute.
But the issue goes beyond the tender process.
At stake is the technology that will support how Kenya manages, transmits, stores and verifies election results in the August 2027 General Election.
PPARB directed IEBC to review and amend its tender for the supply, installation, testing, commissioning, support and maintenance of an Integrated Elections Management System (IEMS).
IEBC must also give prospective bidders at least seven days to consider the changes before they submit or revise their bids.
That correction matters. But the larger question is whether the revised tender will address the concerns that have followed Kenya’s election technology from one election cycle to the next.
The latest dispute followed a challenge by Galadirel Investment Limited over what it described as restrictive specifications and the non-disclosure of key contract details.
Much of the attention has therefore focused on the procurement process and the companies that could win the eventual contract.
But the more important issue comes after the supplier is selected.
Kenya will rely on an integrated technology system to support critical parts of election management. That raises questions about who controls the systems, who can examine them and what happens if the supplier cannot provide the required service.
A procurement process can comply with the law and still leave questions about technical control and independent verification.
That is why the revised tender matters beyond the companies competing for it.
Kenya’s 2022 election provides an important reference point because it showed how election technology can raise questions beyond the purchase of equipment.
The core technology contract for the Kenya Integrated Elections Management System (KIEMS) went to Smartmatic International Holding B.V. in 2021. IEBC says the contract covered the supply, installation, testing, commissioning, support and maintenance of KIEMS and related hardware.
The procurement itself faced legal challenges before the election. The Supreme Court record shows that IEBC advertised an open international tender and received bids from five firms before Smartmatic was selected. The award was challenged but ultimately upheld.
Smartmatic provided technology for voter identification and results transmission. IEBC also had existing technology supplied by IDEMIA. IEBC’s 2022 audit timeline shows that the IDEMIA system was decommissioned in March 2022, followed by the migration of voter data to the Smartmatic system for further processing.
The result was a technology environment involving several systems, suppliers and layers of verification.
Verification in 2022 did not depend on one person or one institution. IEBC had an audit arrangement with Serianu Limited for election technology, while KPMG separately audited the register of voters.
Political parties and their agents also had a role in checking results at polling and tallying centres. They could receive copies of result forms and compare those figures with results published through IEBC’s online portal.
Observers and civil society groups provided another layer of scrutiny.
The publication of scanned polling-station results also allowed journalists, political parties, civil society and members of the public to compare electronically transmitted results with the forms generated at polling stations.
The Supreme Court later found that the technology used in the 2022 election met constitutional requirements for integrity, verification, security and transparency. It also found no credible evidence of unauthorised access or a security breach in the results-transmission system.
That distinction matters.
The 2022 record does not establish that election technology was compromised. It does, however, raise a different question for 2027: how much technical access should independent experts have before and after an election?
That includes access to source code where necessary, algorithms, security logs, system documentation, data infrastructure and the path through which results move from polling stations to the public results platform.
The revised IEMS tender therefore needs to make the relationship between IEBC and the eventual technology provider clear.
Private companies can provide election technology. The issue is what happens when a private supplier becomes critical to the operation of the electoral system.
IEBC needs clear rights to inspect the system and access the information required to operate and audit it. That includes software configurations, technical documentation and system records.
The question is simple: can Kenya independently understand, audit and replace critical parts of its election infrastructure if the supplier is no longer available?
That is different from ordinary procurement.

Trust in election technology also cannot depend only on the reputation of the company that supplies it.
Qualified independent technical experts need a clear way to examine critical parts of the system before and after an election.
They do not need access to every technical detail. They need enough access to examine the parts that affect election integrity and explain their findings.
The same principle applies to testing.
Mock elections, security tests and other technical exercises can expose weaknesses before election day. But those tests have greater value when independent experts can examine what was tested, what failed and what was fixed.
A system that works during a demonstration is not necessarily ready for the pressure and scale of a national election.
Data hosting is another issue the revised procurement needs to address.
The tender should clearly establish where voter and election-results data will be stored, who can access it and what role external vendors have in managing it.
Election data is not ordinary commercial information.
The companies and institutions that control the infrastructure around it can have significant technical access to systems at the centre of the electoral process. That makes data governance part of election integrity.
The procurement also needs a clear exit plan.
The contract should provide for technical handover, documentation, staff training and continuity if a supplier exits, loses the contract or cannot provide support.
The same applies to election-day failures.
IEBC needs reliable fallback procedures if technology fails during voting or results transmission.
A digital system does not remove the need for a functioning manual process. It makes that backup more important.
The amended procurement gives IEBC an opportunity to establish clearer standards in five areas: independent auditing, data governance, IEBC access and control, supplier exit and continuity, and independent testing.
Qualified experts should have defined access to the technical information required to examine critical systems. The contract should establish where election data is stored, who can access it and what safeguards apply. IEBC should have meaningful rights to operate, inspect and maintain critical parts of the system.
There should also be clear arrangements for documentation, technical handover and fallback systems if the supplier exits or the system fails. Major technical and cybersecurity tests should take place well before the election, with appropriate findings made available to stakeholders.
These are not simply technical requirements.
They determine how much of Kenya’s election infrastructure remains under public control and how much depends on private suppliers.
The success of the revised tender should therefore not be measured only by whether IEBC avoids another procurement challenge.
It should also be measured by whether the resulting system can withstand independent scrutiny.
Voters, political parties, civil society and technical experts should not have to rely entirely on assurances from IEBC or its technology provider. They need defined ways to examine how the system works and how results move through it.
Kenya cannot eliminate every election dispute through technology.
Technology can improve speed, record keeping and results management. It can also create new points of dependency when critical infrastructure rests with a small number of suppliers.
The 2027 election will therefore test more than IEBC’s ability to procure a new system.
It will test whether Kenya has learned from the technology and transparency questions that emerged in 2022.
As IEBC revises the tender, the important question is not simply which company will win the contract.
It is how much control Kenya will retain over the technology that carries its election results, and how independently those results can be verified.
