September 02, 2026 - A 55-year-old man was on Wednesday charged at the Garissa Law Courts with defiling a 13-year-old boy in Rahole village, Balambala Sub-County.
The accused appeared before Resident Magistrate Robert Lemayan where he faced two counts of defilement contrary to Section 8(1)(3) of the Sexual Offences Act, 2006 and an alternative charge of committing an indecent act with a child contrary to Section 11(1) of the Act.
He denied the charges.
Prosecution counsel Daniel Kariuki told the court that the accused allegedly committed the offence on August 27 and 29, 2026.
The court heard that on August 29, the accused was allegedly found in a manyatta where the minor had been herding goats. The boy's mother, who reportedly found him in the act, raised alarm and reported the matter to police the following morning.
The minor was taken to Balambala Sub-County Hospital where he was examined and treated.
The prosecution told the court that police visited the scene on September 1 and arrested the accused, who allegedly admitted to the offence during interrogation.
The prosecution opposed his release on bail, citing alleged threats to a witness, and asked the court to set a pre-trial date.
The magistrate directed that the case be mentioned on September 16, 2026, for further directions.
